Terms & Conditions

Please read these Terms and Conditions (“Terms”) carefully before using SayOlá, the web & mobile application that helps you practise Brazilian-Portuguese conversation through AI-powered role-play (“Service”).
By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not access the Service.

1. Eligibility & Accounts

You must be at least 13 years old (or the minimum legal age in your jurisdiction). Users under 18 need verifiable parental consent.
You agree to provide accurate registration data, keep it up-to-date and maintain the confidentiality of your login credentials.
You are responsible for all activity that occurs under your account, including any use of the push-to-talk microphone feature and AI chat.

2. Limited Licence

Subject to your compliance with these Terms, SayOlá Inc. grants you a personal, non-exclusive, revocable licence to use the Service solely for non-commercial language-learning.

3. Acceptable Use

You agree not to, either directly or indirectly:

Record or upload audio that is unlawful, harassing, hateful, pornographic, infringing or otherwise objectionable.
Reverse-engineer, decompile or attempt to extract the source code of any part of the Service or its AI models.
Interfere with or disrupt servers, APIs, databases, storage buckets or voice-chat WebSocket endpoints.
Bypass authentication, rate-limits or signed-URL expiry timers used for temporary TTS audio.
Use the Service to build or train competing language or speech products.

4. AI-Generated Content & Speech Recordings

Voice Recordings. By using the push-to-talk feature you authorise SayOlá to capture your microphone audio, upload it to our servers and forward it to our speech-to-text vendor (currently Deepgram). Recordings are stored only as long as necessary to provide the transcript and are deleted within 48 hours.
AI Output. Lesson prompts, chat responses and TTS audio are generated by large language models (OpenAI GPT-4.1) and TTS engines (Cartesia AI, Deepgram or OpenAI). Output may occasionally be inaccurate, offensive or otherwise unexpected; you rely on it at your own risk.
Learning Accuracy. Although scenarios are crafted by language educators, SayOlá does not guarantee that you will achieve any specific proficiency level. Always consult a qualified teacher if you need certified language assessment.

5. Third-Party Services & Integrations

The Service incorporates:

Authentication – Kinde (OAuth 2.0) & Firebase Authentication
Cloud Storage & Database – Google Cloud Storage, Firebase Cloud Firestore
Speech Recognition & TTS – Deepgram, OpenAI, Cartesia AI
Payments – Stripe

Your data may transit or be processed by these providers subject to their own terms and privacy policies.

6. Subscriptions & Payments

Premium features (e.g. larger TTS quota, additional scenarios, CEFR analytics) are sold via Stripe-powered checkout or in-app purchase. Pricing, renewal and cancellation details are presented before purchase. All fees are charged in the currency shown at checkout and are non-refundable except where required by law.

7. Intellectual Property

All scenario artwork, source code, databases and trademarks (including the SayOlá name and logo) remain the exclusive property of SayOlá Inc. or its licensors. You may not reproduce or distribute any part of the Service without prior written consent.

8. Privacy & Data

We collect and store:

Account details (name, email) via Firebase Authentication;
Learning preferences (voice speed, voice gender, language level) in Firestore;
Ephemeral voice recordings & temporary TTS audio files (auto-deleted);
Scenario progress for internal analytics.

9. Suspension & Termination

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or if your use poses risk to other users or infrastructure. Upon termination your right to use the Service ceases immediately.

10. Disclaimers

No Warranties. The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind.

Educational Use Only. SayOlá is not a substitute for accredited language courses, professional translation or certified interpretation.

Connectivity & Device Requirements. Recording and playback quality depend on your hardware, browser permissions and internet connection.

11. Limitation of Liability

To the extent permitted by law, SayOlá Inc. shall not be liable for indirect, incidental, special or consequential damages, including loss of data, profits or learning opportunities, arising out of or related to your use of the Service.

12. Indemnification

You agree to defend and indemnify SayOlá Inc. from any claim or demand (including reasonable attorneys’ fees) arising out of your misuse of the Service or violation of these Terms.

13. Changes to These Terms

We may modify these Terms at any time. If a revision is material we will give at least 14 days’ notice via email or in-app banner. Continued use after the effective date constitutes acceptance.

14. Governing Law & Venue

These Terms are governed by, and construed in accordance with, the laws of Ireland, without regard to conflict-of-law principles. You agree that any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the Irish courts, with primary venue in Dublin, Ireland.
